HomeMy WebLinkAboutOrdinance 11543ORDINANCE NO. ~/ AN ORDINANCE ESTABLISHING THE COMMUNITY DEVELOPMENT COUNCIL FOR PURPOSES OF ADVISING THE CITY COUNCIL ON COMMUNITY DEVELOPMENT BLOCK GRANT-FUNDED PROJECT PRIORITIES, ESTABLISHING MEMBERSHIP OF THE COUNCIL; ESTABLISHING STAFFING FOR THE COUNCIL; AND ESTABLISHING THE DUTIES OF THE COUNCIL; PROVIDING FOR REPEAL OF ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. A citizen's advisory board to be known as the Community Development Council is hereby established for the purposes of advising the City Council on setting priorities for projects funded through the Community Development Block Grant program of the United States Department of Housing and Urban Development and complying with all requirements imposed by the United States government regarding the Community Development Block Grant program. SECTION 2. Subject to the provisions of Chapter 2 "Administration" Article III "Boards and Commissions", Division 3 of the Code of the City of Fort Worth, Texas (1986), as amended, the Community Development Council shall be comprised of nine (9) membership places. The City Council shall appoint one citizen of the City of Fort Worth to serve in each place. Members appointed to odd numbered places shall have terms which expire in odd numbered years, and members appointed to even numbered places shall have terms which expire in even numbered years. Members shall serve two-year terms, and no member shall serve more than three consecutive two-year terms. Members shall serve without compensation and may be removed at any time by the City Council. SECTION 3. Staff support of the Community Development Council will be as assigned by the City Manager. SECTION 4. The Community Development Council shall review, hold public hearings on and make recommendations to the City Council concerning proposals for funding with Community Development Block Grant monies. Such recommendations shall be advisory only and not be binding on the City Council. SECTION 5. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), asramended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 6. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and -2- sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 7. This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained.
