AN ORDINANCE AMENDING THE CODE OF THE CITY OF FORT
WORTH (1986), AS AMENDED, BY THE AMENDMENT OF CHAPTER
6, "ANIMALS AND FOWL", BY THE ADDITION OF A NEW ARTICLE
XI, ENTITLED "ANIMAL SHELTER ADVISORY COMMITTEE",
PROVIDING FOR THE CREATION, COMPOSITION, AND
RESPONSIBILITIES OF SUCH COMMITTEE; PROVIDING FOR THE
MEETINGS OF SUCH COMMITTEE; PROVIDING THAT THIS
ORDINANCE IS CUMULATIVE; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING THAT THIS
ORDINANCE MAY BE PUBLISHED IN PAMPHLET FORM; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
Section 1
That the Code of the City of Fort Worth, Texas (1986), as
amended, is amended by the amendment of Chapter 6, "Animals and
Fowl", of said code, through the addition of a new Article XI,
entitled "Animal Shelter Advisory Committee", to read as follows:

(d) Appointments shall be as follows:
(1) Places 1, 3, 5, and 7 - Terms expire each October first

members shall expire October 1, 1996.
(e) The composition of the committee shall include at least one
licensed veterinarian, at least one municipal official, at
least one person whose duties include the daily operation of
an animal shelter, and at least one representative from an
animal welfare organization. The same person shall not be
appointed to fulfill more than one of these requirements
(f) Members of the committee shall be subject to removal at any
time by the City Council Any vacancy in the membership of
the Committee shall be filled by the City Council for the
unexpired term of the member whose place has, by removal or
otherwise, become vacant. Vacancies shall be filled within
sixty (60) days after the City Council removes the member or
within sixty (60) days after the City Council receives
notice of the member's resignation.
Sec. 6 - 86 Committee Meetings.
(a) The committee shall meet a minimum of three times per
calendar year.
(b) A quorum of the committee shall consist of a majority of the
members, excluding any vacancies The presence of a quorum
of the committee shall be required prior to a meeting being
called to order
(c) Approval of all items before the committee shall require a
majority vote of those in attendance.
(d) The committee may adopt rules, subject to City Council
approval, for the conduct of its meetings
Section 2.
This ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth, Texas
(1986), as amended, except where the provisions of this ordinance
are in direct conflict with the provisions of such ordinances and
such Code, in which event conflicting provisions of such
ordinances and such Code are hereby repealed

Section 3
It is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and
phrases of this ordinance are severable, and, if any phrase,
clause, sentence, paragraph, or section of this ordinance shall
be declared void, ineffective, or unconstitutional, by the valid
judgment or decree of any court of competent jurisdiction, such
voidness, .ineffectiveness, or unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would
have been enacted by the City Council without the incorporation
in this ordinance of any such void, ineffective, or
unconstitutional phrase, clause, sentence paragraph, or section.
Section 4.
All rights and remedies of the City of Fort Worth, Texas,
are expressly saved as to any and all violations of the
provisions of any ordinances affecting animals which have accrued
at the time of the effective date of this ordinance; and, as to
such accrued violations and all pending litigation, both civil
and criminal, whether pending in court or under such ordinances,
same shall not be affected by this ordinance but may be
prosecuted until final disposition by the courts
Section 5.
The City Secretary of the City of Fort worth, Texas is
hereby authorized to publish this ordinance in pamphlet form for
general distribution among the public, and the operative
provisions of this ordinance as so published shall be admissible
in evidence in all courts without further proof than the
production thereof, as provided in Chapter XXV, Section 3, of the
Charter of the City of Fort Worth, Texas
Section 6.
This ordinance shall be in full force and effect from and
after its passage, and it is so ordained.

RECOMMENDATIONS
It is recommended that the City Council
1 Amend Chapter 6, "Animals and' Fowl of the Code of the City of Fort Worth" by
creating the term and definition of "Animal Control Advisory Committee" in Section
6-1, Definitions,
2 Approve the number of members of the Animal Control Advisory Committee as
seven to include at least one licensed verterinarian, at least one municipal official,
at lest one person whose duties include the daily operation of an animal shelter and
at least one representative of an animal welfare organization
3 Approve the length of the terms served by the Animal Control Advisory Committee
members as two years (staggered), such committee shall meet a minimum of three
(3) times per year, ~ -
4 Approve the list of candidates submitted by the Director of Public Health as the
initial members of the Animal Control Advisory Committee, and
5 Approved the attached ordinance which addresses the above
DISCUSSION
By state statute, the City is required to have an animal control advisory committee
Vernon's Texas Codes Annotated, Health and Safety Code, Section 823 005, requires
each municipality in which an animal shelter is operated to appoint an advisory committee
to assist in complying with the requirements of animal shelter regulations At a minimum,
the committee must consist of four persons at least one licensed veterinarian, at least
one municipal official, at least one person whose duties include the daily operation of an
animal shelter, and at least one representative from an animal welfare organization This
committee must meet at least three (3) times per year
FISCAL INFORMATION/CERTIFICATION
The Director of Fiscal Services certifies that no expenditure of City funds will result from
establishing this Advisory Committee
