ORDINANCE NO
AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE SEWER CAPITAL PROJECTS FUND IN
THE AMOUNT OF $194,400.00 FOR THE PURPOSE OF FUN~ING A
CONTRACT WITH OSCAR RENDA CONTRACTING, INC ,
PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND
REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH,
AND PROVIDING AN EFFECTIVE DATE.
BE TT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1
That in addition to those amounts allocated to the various City departments for the Fiscal Year 1993-
94 and in the Budget of the City Manager, there shall also be increased estimated receipts and
appropriations in the Sewer Capital Projects Fund in the amount of $194,400.00 for the purpose of
funding a contract with Oscar Renda Contracting, Inc., for Village Creek Wastewater Treatment Plant,
Long-Term Solids Dewatering,,Processing, and Disposal.
SECTION 2.
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no
way impair the remaining portions, sections, or parts of sections of this ordinance, which said
remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No 11379 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are
in direct conflict with such other ordinances and appropriations, in which instance said conflicting
provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect and be in full force and effect from and after the date of its passage,
and it is so ordained.

RECOMMENDATION
It is recommended that the City Council
Authorize the City Manager to transfer $2,505,600 00, from Water and Sewer Operating
Fund PE45 to Sewer Capital Project Fund, and ,
2 Adopt the attached appropriations ordinance increasing estimated receipts and
appropriations by $194,400 00 in the Sewer Capital Projects Fund from accumulated
impact fees, and
3 Authorize the City Manager to transfer 5136,080 00 from Impact Fees Retail and
558,320 00 from Impact Fees Wholesale to the Long Term Solids De-watering, Processing
and Disposal Project in the Sewer Capital Projects fund, and
4 Authorize the City Manager to execute a contract with Oscar Renda Contracting, Inc for
the long term dewatering and disposal at the Village Creek Wastewater Treatment Plant in
the amount of 524,857,000 00, based on a five-year commitment calculated on the total
projected quantities, with annual funding of which 2 7 millon is available and the current
TNRCC permit requirements and the pre-approved conceptual plan, and further to direct the
staff to negotiate with Bio-Gco for the construction of a permitted composting facility with
capabilities of processing up to 30% of the contemporary sludge This should include

DISCUSSION
On May 5, 1993 (M&C C-13812), the City Council authorized an engineering contract to prepare
plans and other contract documents for long term sludge dewatering facility at the Village Creek
Wastewater Treatment Pliant The staff and a variety of nationally recognized experts developed
a scope of work for the long term facility that would be capable of processing all the sludge
produced by the treatment plant
In an effort to assure the City with maximum flexibility, the specifications for the facility were
designed to be performance based, with certain general standards outlined (i a ,equipment,
building, dimensions, etc) The intended result was to construct acost-effective long term
facility capable of dewatering and producing a class "B" grade of sludge An alternate for a class
"A" grade of sludge was also included again to assure maximum flexibility

Bids were opened in September 1993, based on these objectives and specifications Four
vendors responded, however, as the bids were being evaluated, two of the bidders raised
questions concerning the complexity and some confusion in the performance based contractual
approach
After reviewing the various options, the City staff recommended that all bids be rejected and that
each vendor be provided an opportunity to negotiate a proposal which covered a number of
options and alternatives that could 6e appropriately evaluated by the City staff and Council
On January 20, 1994, the staff invited the four vendors to a briefing and answered the concerns
raised by the two bidders Each vendor was then invited to meet in confidential negotiations
with the City's negotiating team BFI chose not to participate BIO-GRO, Oscar Renda and PSG
accepted the offer and negotiations occurred over athree-week period ending on February 23,
1994
The results of the negotiations were summarized in a report (attachment 1) and presented to the
City Council at the March 8, 1994 pre-council meeting The Council expressed an interest in
opening the deliberations on the project to a public hearing The public hearing, conducted by
City staff, was held on March 22, 1994 at 7 00 P M in the City Council Chamber An opening
statement on the background and purpose of the hearing was presented by staff Next, the three
vendors provided 20-minute presentations of their respective proposals which were followed by
public comment• Eleven (1 1) citizens provided comments The hearing was closed at
approximately 9 30 P M
After consideration of three negotiated proposals, the City staff recommends award of the
contract to Oscar Renda Contracting, Inc based on the attached report (attachment 2)
Oscar Renda Contracting, Inc ~ has proposed DBE participation of between 32% to 35% thus
exceeding the City's DBE policy
A "funding out" clause will be included in the contract which will require that each year be
funded on an annual basis from operating budget At this time funding is provided for
construction, of the facility only

FISCAL INFORMATION/CERTIFICATION
The Director of Fiscal Services certifies that upon approval and completion of recommendation
1, the adoption of the attached appropriations ordinance and the approval and completion of
recommendation 3, funds required for the construction phase of the contract will be available in
the current capital budget of the Sewer Capital Projects Fund
