AN ORDINANCE VACATING, ABANDONING AND CLOSING AND
EXTINGUISHING SIX (6) UTILITY EASEMENTS LOCATED IN THE
ARBOR PARK ADDITION TO THE CITY OF FORT WORTH, TEXAS;
PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the six (6) utility easements as follows: (1) a 10 foot
utility easement located along the east property line of Lot 17,
Block 1; (2) a 7.5 foot TESCO easement along the south property
line of Lot 33, Block 1; (3) a 5 foot aerial easement located along
the east property line of Lot 57, Block l; (4) a 7.5 foot TESCO
easement located along the south property line of Lot 32, Block 2;
(5) a 5 foot utility easement and; (6) a 7.5 foot TESCO easement
located along the east property line of Lot 40, Block 2, and as
more specifically described in Exhibit A attached hereto and
incorporated herein be and the same is vacated, abandoned and
permanently closed and extinguished.
SECTION 2.
That the fee to the land in the above described vacated
utility easement is hereby released and shall revert to the
adjacent owner as provided by law.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.

SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so
ordained.

RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance vacating six (6) utility
easements as follows 10 foot utility easement located along the east property line of Lot 17,
Block 1, 7 5 foot TESCO easement located along the south property line of Lot 33, Block 1, 5
foot aerial easement located along the east property line of Lot 57, Block 1, 7 5 foot TESCO
easement located along the south property line of Lot 32, Block 2, a 5 foot utility easement and
a 7 5 foot TESCO easement located along the east property line of Lot 40, Block 2, Arbor Park
Addition, as recorded in Volume 388-208, page 60, P R T C T
DISCUSSION
Arbor Park Equity Fund, owner of all associated properties, has requested that the City vacate
the above-described utility easements, for the purpose of replatting the subject properties into
larger lots for development purposes The subject utility easements do not contain any utility
facilities or acceptable arrangements have been made for relocation of any existing utility
facilitles into newly-dedicated utility facllities identified on the replat of the subject properties
Reviewing City departments and private utility companies have raised no objections to this
request A satisfactory replat has been submitted
This request is located in COUNCIL DISTRICT #4
FISCAL INFORMATION/CERTIFICATION
The Land Agent for the City of Fort Worth has determined that a one dollar fee satisfies the
interest of the City of Fort Worth in this request
