ORDINANCE NO 1~ ~1~
AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE ENVIRONMENTAL MANAGEMENT
FUND IN THE AMOUNT OF $255,777.66 FOR THE PURPOSE OF
FUNDING A CONTRACT FOR THE REMOVAL OF UNDERGROUND
STORAGE TANKS AND THE INSTALLATION OF ABOVE GROUND
VAULTS, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN
CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
BE .IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1
That in addition to those .amounts allocated to the various City departments for the Fiscal Year
1994-95 and in the Budget of the City Manager, there shall also be increased estimated receipts and
appropriations in the Environmental Management Fund in the amount of $255,777:66 for the purpose of
funding a contract with Eagle Construction for the removal of 15 underground storage tanks and the
installation of 6 above ground vaults. ~
SECTION 2.
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no
way impair the remaining portions, sections, or parts of sections of this ordinance, which said
remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 11645 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are
in direct conflict with such other ordinances and appropriations, in which instance said conflicting
provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect and be in full force and effect from and after the date of its passage,
and it is so ordained.

RECOMMENDATION
It is recommended that the City Council
1 Adopt the attached supplements{ appropriations ordinance increasing estimated receipts
and expenditures by $255,777 66 in the Environmental Management Fund from increased
revenues, and
2 Transfer 5255,777 66 from the Undesignated Construction account to the 15 Tanks
project in the Environmental Management Fund, and
3 Transfer 541,956 57 from the Undesignated D+,sposal account to the 15 Tanks project' in
the Environmental Management Fund, and
4 Authorize the City Manager to enter into a contract with Eagle Construction and
Environmental Services, Inc in the amount of 5283,556 23 for the removal of 15
underground storage tanks (UST's) and the installation of 6 above ground vaults at various
City facilities, and
5 Authorize establishment of a 5% protect contingency totaling 514,178 00 to cover any
unanticipated project costs
DISCUSSION
Since 1990, the City of Fort Worth has been involved in a multi-year underground storage tank
compliance program To date, the City has removed in excess of 95 tanks This proposed
contract is the next phase in this compliance program

Eagle Construction and Environmental Services, Inc ,has complied with the City's DBE policy,
by committing to 14 34% DBE participation
The funding for this project is coming from a combination of reimbursements from the Texas
Natural Resource Conservation Commission for previous UST projects and revenue generated by
the 50 cent Environmental Fee
FISCAL INFORMATION/CERTIFICATION
The Director of Fiscal Services certifies that upon approval of recommendations 1, 2 and 3,
sufficient funds for this contract will be available in the current operating budget, as
appropriated, of the Environmental Management Fund
