Ordinance No. 18727-07-2009 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS iN THE GRANTS FUND IN AN AMOUNT UP TO 587,900.00, UPON RECEIPT flF THE REIMBURSEMENT FROM THE UNITED STATES EQUAL EMPLOYMENT OPPORTUNITY COMMiSS1flN, FOR THE PURPOSE OF FUNDING A CONTRACT WITH THE UNITED STATES EQUAL EMPLOYMENT OPPORTUNITY COMMISSION TO PROCESS EMPLOYMENT DISCRIMINATION CASES; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH: AND PROVIDING AN EFFECTIVE DATE. BE 1T ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts ailacated to the various City departments for Fiscal Year 2008-2009, there shall also be increased appropriations in the Grants Fund in an amount up to 587,900.00, upon receipt of the reimbursement from United States Equal Employment Opportunity Commission, for the purpose of funding a contract with the United States Equal Employment Opportunity Commission to process employment discrimination cases. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 18283 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the City Manager to execute a contract with the United States Equal Employment Opportunity Commission in an amount up to $87,900.00; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in an amount up to $87,900.00. DlscusslflN: In January 1977, the United States Equal Employment Opportunity Commission {EEOC} recognized the Community Relations Department {GRD} as a local deferral agency and a Fair Emplayment Practice Agency {FEPA} in accordance with Section 706 {c} of the United States Equal Emplayment Opportunity Act of 1972, Title Vll of the Civil Rights Act of 1964, as amended. Pursuant to this section, the EEOC, prior to asserting jurisdiction aver employment discrimination charges, defers such charges for resolution to a local or state agency having authority to enforce a local or state fair employment law similar to Title Vll, the Age Discrimination in Emplayment Act and the Americans with Disabilities Act. Far Fiscal Year 2009, the GRD, in accordance with EEOG guidelines, submitted a request to the EEOC for partial reimbursement of program expenditures in the amount of $102,750.00. The performance period for the contract is Qctober 1, 2008, through September 30, 2009. As outlined above, the total amount of the contract is $87,900.00. FISCAL INFCIRMATION 1 CERTIFICATIt?N: The Financial Management Services Director certifies that upon approval of the above recommendations, receipt of the grant and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Grants Fund.
