ORDINANCE NO. ,~1~,! "='
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND
EXTINGUISHING A UTILITY AND DRP,INAGE EASEMENT LOCATED
WITHIN THE MIDPARK BUSINESS COMMUNITY ADDITION; PROVIDING
FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL. OF THE CITY OF FORT WORTH,
TEXAS: -
SECTION 1.
THAT the fifty (50) foot wide by approximately four hundred
seventy-four (474) foot long utility and drainage easement located
between Lots 18 and 19 and Lot 20, Midpark Business Community
Addition, as recorded in Cabinet A, Slide 566, Parker County Plat
of Records, and as more specifically described in attached Exhibit
"A", attached hereto and incorporated herein, be and the same is
vacated, abandoned and permanently closed and extinguished.
SECTION 2.
That the fee to the land in the above described vacated
utility and drainage easement is hereby released and shall revert
to the adjacent owner as provided by law.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so
ordained.

Prior to platti'hg, a drainage ditch ran across the Northwestly portion
of the land that is now known as Mid--Park Business Community. The
ditch was to .be relocated during the development of the platted lands
to the North~sterly lines of Lots 17, 18, and 19. Due to harsh eco--
nomic times, the ditch was never physically moved. The original devel-
oper defaulted on the mortgage, the property was foreclosed upon, and
then sold to the current owner. An opportunity has arisen to market
the land in accordance with the proposed replat. The prospective
purchaser wishes to consolidate the four lots into two building sites.
The new lot layout places the drainage easement where the existing
ditch is located.
The closing of the utility easements will facilitate the use of the
revised lot layout. The are no existing utilities within the ease
ments to be vacated.

RECOMMENDATION
It is recommended that the City Council approve the attached ordinance vacating a 50-foot wide
by approximately 474 feet long utility a:nd drainage easement located between Lots 18 and 19
and Lot 20, Midpark Business Community Addition
DISCUSSION '
Mr Henry Maddox, trustee for Louisa Northington Trust, owner of all adjacent property, has
requested that the City vacate the above described utility and drainage easement for the purpose
of relocating the common property line between Lot 20 and Lots 18 and 19 By replat the proper
drainage easement will be established where the actual drainage structure is located Reviewing
City departments and private utility companies have raised no objections to this request An
acceptable replat has been submitted
This request is located in the Extra-Territorial jurisdiction of the City of,Fort Worth
FISCAL INFORMATION/CERTIFICATION
The Land Agent for the City of Fort Worth has determined that a one dollar (S1 00) fee satisfies
the interest of the City of Fort Worth in this request
