HomeMy WebLinkAboutOrdinance 11303ORDINANCE N0. // 3~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTINGUISHING A DRAINAGE EASEMENT LOCATED WITHIN THE SANTA FE SOUTHWEST INDUSTRIAL PARK TO THE CITY OF FORTH WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the fifteen (15) foot wide drainage easement located on Lot 2-B-2, Block 1~Santa Fe Southwest Industrial Park, as recorded in Cabinet A, Slide 1151, P.R.T.C.T., and as more specifically described in attached Exhibit "A", attached hereto and incorporated herein, be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated drainage easement is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. DISCUSSION: The Educational Employees' Credit Union, owner of the subject property, has requested that the City vacate the above-described drainage easement (exhibit attached). This drainage easement is being relocated for the purpose of providing a more usable development site for new construction of a credit union facility. Reviewing City departments and private utility companies have raised no objections to this request. A satisfactory replat has been submitted. This request is located in COUNCIL DISTRICT 6. FISCAL INFORMATION/CERTIFICATION: The Land Agent for the City of Fort Worth has determined that a one dollar fee satisfies the interest of the City of Fort Worth in this request.
