HomeMy WebLinkAboutOrdinance 11310e [- ~ ~x '. , ORDINANCE NO /~~ AN ORDINANCE APPROPRIATING $125,000 00 TO THE WATER AND WASTEWATER OPERATING FUND AND DECREASING THE UNRESTRICTED, UNDESIGNATED RETAINED EARNINGS BY THE SAME AMOUNT FOR THE PURPOSE OF PAYING FEES TO KELLY, HART AND HALL, ATTORNEYS AT LAW, FOR THE PURPOSE OF REPRESENTATION IN THE ARLINGTON RATE CASE AND LITIGATION; PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR },: ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1992-93 and in the Budget of the City Manager, there shall also be increased appropriations in the Water and Wastewater Operating Fund in the amount of $125,000 00 thereby decreasing the unrestricted, undesignated Retained Earnings by the same amount for the purpose of paying for the special expertise and assistance in the Arlington Rate Case and litigation provided by Kelly, Hart and Hallman, Attorneys at Law. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 This ordinance shall be cumulative of Ordinance No 10892 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting prov~.saons of said prior ordinances and appropriations are hereby expressly repealed UFFlCIAL RECORD CITY SECRETARY FT. Adopt the attached supplemental appropriation ordinance increasing the Water and Wastewater appropriation by $125,000.00 and decreasing the Unreserved, Undesignated Water and Wastewater Fund balance by the same amount. 2. Authorize the City Manager to continue employment of Kelly, Hart and Hallman, Attorneys At Law, as an outside counsel to provide special expertise and assistance in the Arlington Rate Case and litigation, in an amount not to exceed $125,000.00, and DISCUSSION: On July 16, 1991, (M&C G-9219), the City Council authorized the retention of Kelly, Hart, and Hallman as outside counsel to assist the City Attorney on an interim basis in the preparation and presentation of the City's interest in matters related to water and wastewater issues. The contract was continued May 12, 1992 (M&C G-9646) and October 20, 1992 (G-9894). The proposed continued service will be utilized for the ongoing litigation and rate case with the City of Arlington. It is estimated that the representation will cost approximately $125,000.00 through the end of this fiscal year. FISCAL INFORMATION/CERTIFICATION: The Director of Fiscal Services certifies that upon adoption of the supplemental appropriation ordinance, funds required for this expenditure will be available in the Water and Sewer Operating Fund.
