HomeMy WebLinkAboutOrdinance 11311r .,a`1r, ORDINANCE NO f~~ l~ AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND IN THE AMOUNT OF $9,500 00 FOR THE PURPOSE OF FUNDING AN AGREEMENT WITH MAX COURTNEY DBA FORENSIC CONSULTANT SERVICES FOR PROFESSIONAL SERVICES` RELATED TO INTOXILYZER TESTING AND PROVIDING EXPERT TESTIMONY, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1992-93 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund in the amount of $9,500 00 for the purpose of funding an agreement with Max Courtney dba Forensic Consultant Services for professional services related to intoxilyzer testing and providing expert testimony SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 11151 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Adopt the attached supplemental appropriations ordinance for $9,500.00 increasing estimated receipts and revenue in the Special Trust Fund from increased revenue, and 2. Authorize the City Manager to execute a contract with Max Courtney doing business as Forensic Consultant Services for professional services related to intoxilyzer testing and providing expert testimony. DISCUSSION: In 1985 when the Police Department turned over jail operations to Tarrant County, the department also began using Forensic Consultants for DWI intoxilyzer test monitoring. Forensic Consultants provides technical supervision, oversight of intoxilyzer tests and maintenance of testing equipment. Also, as required by state law Forensic Consultants submits reports to the state Scientific Director of Alcohol Testing Program on all tests conducted by departmental personnel and conducts the annual certification of our operators. The information gathered by these tests is evidentiary and must be certified as accurate before DWI cases can be filed against an individual. The Police Department is a participant in Area 22 which certifies tests for numerous law enforcement agencies in the area through Forensic Consultants. Forensic Consultants has not charged a fee for their services since 1985, however they have recently informed the Police Department that they will now begin charging $.7.50 per test. We project on average 140 intoxilyzer tests will be conducted pe.r month which will cost approximately $9,500.00 for the remainder of the fiscal year. If we do not begin payment for these tests we will not have the ability to perform intoxiiyzers tests at the jail. Intoxilyzer tests would have to be contracted out with another agency at a much higher cost and result in considerable time lost for officers transporting suspected DWI cases for testing then back to the jail if it were necessary to place the individual in jail. The costs to hire our own personnel and purchase the equipment would be much more than the costs required to pay Forensic Consultants to continue to certify our testing. Therefore, the department is requesting the use of Awarded Assets to pay for these tests for the remainder of the fiscal year to Forensic Consultants.
