HomeMy WebLinkAboutOrdinance 114151' ORDINANCE NO ~~d AN ORDINANCE APPROPRIATING $168,000 00 TO THE GOLF COURSE FUND AND DECREASING THE UNRESERVED, UNDESIGNATED RETAINED EARNINGS BY THE SAME AMOUNT FOR THE PURPOSE OF FUNDING A CONTRACT FOR THE INSTALLATION OF A BRIDGE AT SYCAMORE CREEK GOLF COURSE, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1993-94 and in the Budget of the City Manager, there shall also be increased appropriations in the Golf Course Fund in the amount of $168,000 00, thereby decreasing the unreserved, undesignated retained earnings by the same amount, for the purpose of funding a contract with Architectural Utilities, Inc., for the installation of a bridge at Sycamore Creek Golf Course. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No 11379 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. It is recommended that the City Council Adopt the attached supplemental appropriations ordinance increasing appropriations in the Golf Course fund by S 168,000 00 and decreasing the unreserved, undesignated retained earnings by a like amount, and 2 Authorize the City Manager to transfer funds in the amount of S 168,000 00 from the Golf Course Fund to the Park and Recreation Improvement Fund, and 3 Authorize the City Manager to execute a contract with Architectural Utilities, Inc , in the amount of S 168,000 00 for bridge installation at Sycamore Creek Golf Course DISCUSSION The 1986 Bond Program allocated 51 5 million for the renovation of Sycamore Creek Golf Course On August 28, 1990 (M&C C-12490), the City Council authorized the City Manager to execute a contract with Poe Engineers, Inc , in the amount of S 158,000 00 for consulting services and construction documents for Sycamore Creek Golf Course Development plans included pro shop/maintenance facilities in addition to golf course reconstruction On February 25, 1992 (M&C C-13256), the City Council authorized the City Manager to execute a contract with Randall and Blake, Inc ,for construction of the golf course in the amount of S 1,286,040 00 This contract consisted of demolition of the existing course and installation of an expanded nine hole golf course with irrigation, cart trails, ponds, improved turf system, low water crossings and various site amenities Construction began April 3, 1992 and final inspection took place on July 28, 1993 As the result of heavy rains during the late Spring season, one of the two low water crossings on the golf course received substantial damage Prior to repairs being made to the damaged low water crossing, additional local flood events rendered the structure unpassable Final determination of the exact cause of failure and responsible parties has not been established, however, the City will continue investigation and negotiation with all involved parties to determine FROM TH'E GOLF COURSE FUND TO THE PARK AND RECREATION IMPROVEMENT FUND Shortly after the failure of the low water crossing, the consulting engineer was directed to design a solution The redesign was to stabilize the low water crossing within the existing condition of the alluvial soils with the expected full inundation by a five year storm event Pricing for this solution was received from Coronado Builders, Inc ,the general contractor presently on-site constructing the clubhouse and maintenance complex The price which- was submitted was unacceptable to both the City and consulting engineer On August 13, 1993, a meeting was held at the site with representatives from the Park and Recreation Department, Department of Law, Transportation and Public Works, Poe Engineers, Inc ,and the Corps of Engineers Due to the potential of future loss and damage to both City property and other newly constructed improvements, the Department of Law determined that immediate action was warranted It was recommended that the City identify general contractors with experience and expertise in construction who could address floodway crossings These contractors were to develop a solution and determine probable cost In the opinion of the Department of Law,the departure from normal bidding procedures inclusive of DBE, was legally justifiable in accordance with state bidding laws because of unforeseen damage to City property and in order to preserve such property During the week of August 16, 1993, the City and consulting engineer met with four contractors who were qualified to perform these services The selection of the contractor was to be based upon their experience, recommended solution, availability and probable cost Following these on-site interviews, the company of Architectural Utilities, Inc (AUI) was selected by the City Plans and specifications were prepared by Poe Engineers, Inc ,and submitted to Architectural Utilities, Inc ,for pricing The base bid totaling 5159,128 00, by Architectural Utilities, Inc , is acceptable to the Park and Recreation Department All such work is to be completed within forty-five (45) calendar days The proposed supplemental appropriation of 5168,000 00 would provide funding for the following items Construction Contract 5159,128 00 Administration, Inspection and 5 8,872.00 Construction Contingency TOTAL
