HomeMy WebLinkAboutOrdinance 11418ORDINANCE NO AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL ASSESSMENT FUND IN THE AMOUNT OF $476,382.00 FOR THE PURPOSE OF PROVIDING FISCAL YEAR 1993-94 FUNDING FOR IMPROVEMENT DISTRICT NO 1, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1993-94 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Assessment Fund in the amount of $476,382.00 for the purpose of providing fiscal year 1993-94 funding for Improvement District No 1 SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No 11379 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. It is recommended that the City Council take the following action regarding Fort Worth Improvement District No. 1 1 Hold a benefit hearing regarding the proposed property assessments for fiscal year 1993- 94 on October 12, 1993, and 2 Close the benefit hearing, and 3 Adopt the attached ordinance which levies the proposed assessments, and 4 Adopt the attached appropriations ordinance increasing estimated receipts and appropriations by $476,382 00 in the special assessments fund DISCUSSION On September 28, 1993 the Council adopted M&C G-10356 which directed that certain improvements and or services (the "improvements") shall be provided in Fort Worth Improvement District No 1 during the 1993-94 fiscal year It also adopted the proposed assessment roll and provided notice of this benefit hearing The improvements to be provided and the costs thereof are Total Cost A maintenance and landscaping program $389,405 00 A promotions program 76,722 00 A marketing program 48,853 00 A security program 12,519 00 A transportation and parking program 1,766 00 City Administrative fee -0- A management program 166,567.00 Total ` 5695,832 00 To Be Assessed $264,921 00 52,722.00 41,824 00 10,024.00 1,291.00 5,000.00 100, 600.00 5476,382.00 The 5219,450 00 difference between total costs and assessments includes 5133,000.00 from the City, 543,000 00_ in revenues from district activities and 543,450.00 in miscellaneous revenues including reserves 1~~ Printed on recycled paper City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE NUMBER BH-O120 LOG' NAME PAGE 10/12/93 13SECUR 2 of 2 SUBJECT BENEFIT HEARING FOR FORT WORTH IMPROVEMENT DISTRICT NO 1 AND LEVYING OF ASSESSMENTS FOR FISCAL YEAR 1993-94 All costs of improvements shall be assessed against private property located in the district and the owners of the property The City Manager has filed with the City Secretary a proposed assessment roll and an estimate of the assessments against each parcel Based on the, appraised value of the property, and considering the benefits to be received from the proposed improvements, it is the opinion of the City staff that each parcel of property will be enhanced in value by an amount equal to or more than the ,proposed assessments upon completion of the improvements in accordance with the contract FISCAL INFORMATION/CERTIFICATION.
