AN ORDINANCE SPECIFYING THE ADJUSTED TOTAL NUMBER OF
AUTHORIZED CIVIL SERVICE POSITIONS AT EACH CLASSIFICA-
TION (RANK) IN THE FIRE DEPARTMENT FOR FISCAL YEAR 1992-
1993; PROVIDING FOR THE DELETION OF FTVE (5) CAPTAIN
POSITIONS; PROVIDING THE STATEMENT OF INTENT TO DELETE
TWO (2) POSITIONS AT VARIOUS RANKS UPON THE OCCURRENCE
OF THE NEXT VACANCY IN SAID POSITIONS; PROVIDING THAT
THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVER-
ABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT
OF THIS ORDINANCE; PROVIDING FOR AN EFFECTIVE DATE.
BE IT HEREBY KNOWN:
WHEREAS, the Fire Chief has requested the City Council to
readjust and thereafter specify the total authorized number of
civil service positions at each classification in the Fire
Department for the remainder of 1992-1993 Fiscal Year; and
WHEREAS, the City's the most recent ordinance concerning the
authorized and budgeted positions for the Fire Department adjusted
the Department's civil service staffing as follows:
Deputy Chiefs 5
Battalion Chiefs 17
Captains 76
Lieutenants 95
Engineers 157
Firefighters 302
TOTAL
652
WHEREAS, in previous ordinances, the City Council has
expressed the intent to reorganize certain duties within the Fire
Department, meaning that from time to time, and as normal attri-
tion from the Department occurred, certain civil service positions
would be deleted while at the same time the Department would
maintain efficient operations by redistributing those duties to

other personnel. This intent was expressed as being in the best
interest of the Fire Department and the City of Fort Worth in
providing the citizens of Fort Worth the most efficient fire
protection possible at the lowest expense necessary; and
WHEREAS, recently five vacancies at the rank of Captain have
occurred and said vacant positions are now subject to deletion as
expressed in said previous ordinances; and
WHEREAS, the Fire Chief now requests the Council to adjust
the authorized number of Fire Department civil service positions
into conformity with the proposed changes as set forth immediately
above in order to effect efficient economy of the operations of
the City's municipal services; and
WHEREAS, the specification and authorization of the correct
number of budgeted civil service positions by ordinance is
required by chapter 143, Texas Local Government Code;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That, effective immediately upon passage of this ordinance,
the following positions are the only civil service positions
authorized in the City of Fort Worth Fire Department for the

remainder of the fiscal year of 1992-1993 or until modified by
subsequent ordinance:
Deputy Chiefs 5
Battalion Chiefs 17
Captains 71
Lieutenants 95
Engineers 157
Firefighters 302
TOTAL 647
*Deletes five (5) Captains positions.
SECTION 2.
The Council also hereby expresses the intent to delete one
{1) more Captain position and one (1) more Engineer position at
the occurrence of the next vacancy in said classified positions.
The intent to delete said positions is expressed so as to negate
any expectancy of promotion into the rank of Captain or Engineer
upon the occurrence of the next vacancy.
SECTION 3.
The "Mayor and Council Communication" memorandum which is
presented contemporaneously with this ordinance is hereby
expressly incorporated herein by reference for further clarifica-
tion and explanation of the purposes and intent of the Council in
their adoption of this ordinance.
SECTION 4.
This ordinance shall be cumulative of all provisions of
previous ordinances and of the Code of the City of Fort Worth,
Texas (1986), as amended, except where the provisions of this
ordinance are in direct conflict with the prov

civil service staffing ordinances for the Fire Department and such
Code, in which event conflicting provisions of such ordinances and
such Code provisions are hereby repealed.
SECTION 5.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and, if any phrase, clause, sen-
tence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted
by the City Council without the incorporation in this ordinance of
any such unconstitutional phrase, clause, sentence, paragraph or
section.
SECTION 6.
This ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

' SUBJECT DELETION OF FIVE CAPTAIN POSITIONS FROM THE FIRE DEPARTMENT
RECOMMENDATION:
It is recommended tfrat the City Council adopt the attached ordinance decreasing the
total number of authorized Fire Captain positions from seventy-six (76) to seventy-one
(71) .
DISCUSSION:
The Fire Department's FY 1992-93 budget includes a reduction of twenty (20) Civil
Service positions of various ranks, nine of which were eliminated October 1
1992
and
,

eleven to be deleted during the fiscal year through normal attrition. On September 29
,
1992, City Council approved M&C G-9865 adopting an ordinance (Ordinance No. 11176)
establishing the authorized strength of Civil Service personnel in the Fire Department
and stating the Fire- Department's intent to delete the eleven (11) additional Civil
Service positions. Such intent was declared so as to negate any employee expectancy

or promotion into the positions as they become vacant. Since that time City Council
has approved the deletion of three Lieutenant positions (M&C G-9974 and M&C G-10036)
and one Deputy Chief position (M&C G-10073).
There are currently five Fire Captain vacancies in the Fire Department with no Civil
Service eligibility list in effect for the positions. Deletion of the five Captain
positions now will change the current authorized strength as follows:
