AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTINGUISHING A UTILITY EASEMENT LOCATED WITHIN THE DIAMOND INDUSTRIAL ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the ten (10) foot wide by approximately six hundred fourteen (614) foot long utility easement located between Lots 1 through 6 and Lots 7 through 12, Block 12, Diamond Industrial Addition, as recorded in Volume 388-49, Page 15, P.R.T.C.T., and as more specifically described in attached Exhibit "A", attached hereto and incorporated herein, be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated utility easement is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. DISCUSSION: The Tarrant County Hospital District, owner of this property, has requested that the City vacate this ut ility easement in order that the area can be developed as a health care facility. The easement contains an existing sewer and water line, however acceptable arrangements have been made for the relocation of these existing lines. Reviewing City departments and private utility companies have raised no objections to this vacation request A satisfactory replat has been submitted. This request is located in COUNCIL DISTRICT 2. FISCAL INFORMATION/CERTIFICATION: The Land Agent for the City of Fort Worth has determined that a one dollar fee satisfies the interest of the City of Fort Worth in this request.
