ORDINANCE NO.
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND
EXTINGUISHING A STREET RIGHT-OF-WAY AND TWO PUBLIC OPEN
SPACE EASEMENTS LOCATED WITHIN THE VILLAGE CREEK ESTATES
ADDITION, TARRANT COUNTY, TEXAS; PROVIDING FOR REVERSION
OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the sixty (60) foot wide by approximately two hundred
seventy-seven point fifteen (277.15) foot long unnamed street
right-of-way located between Lot 15 and Lot 16, Block 1, Village
Creek Estates Addition and the two (2) public open space easements
located at the intersection of the unnamed street right-of-way and
Red Oak Drive and located on Lot 15 and Lot 16, Block 1, Village
Creek Estates Addition, as recorded in Volume 388-108, Page 47,

P.R.T.C.T., and as more specifically described in attached Exhibit
"A", attached hereto and incorporated herein, be and the same are
vacated, abandoned and permanently closed and extinguished.
SECTION 2.
That the fee to the land in the above described vacated street
right-of-way and public open space easements is hereby released and
shall revert to the adjacent owner as provided by law, SAVE AND
EXCEPT that easements are retained for any and all existing and
prospective utilities.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.

That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so
ordained.

(2) VILLAGE CREEK ESTATES ADDITION, BLOCK 1, LOTS 15 AND 16, RED OAK
DRIVE AND LUNAR LANE (V-93-28)
RECOMMENDATION.
It is recommended that the City Council approve the attached ordinance vacating a 60-ft wide
by approximately 277 15 ft long unnamed street right-of-way located between Lots 15 and 16,
Block 1, Village Creek Estates Addition and two public open space easements located at the
intersection of unnamed street right-of-way with Red Oak Drive, also located on Lots 15 and 16,
Block 1, Village Creek Estates Addition and approved by the City Plan Commission on June 30,
1993
DISCUSSION
Mr James Brittain, representing the owners of the adjacent property to Lunar Lane, has
requested that the City vacate the above-described street right-of-way and two public open
space easements for the purposes of expand'ong the existing residential lot The street right-of-
way was dedicated as part of the Village Creek Estates Subdivision to provide a link between
the Oak Grove Subdivision, to the north, and Village Creek Estates Subdivision Since
development of these subdivisions, this link was never completed and has now been determined
as unnecessary An acceptable replat has been submitted Reviewing City departments and
private utility companies have raised no objections to this request
Thisrequest is located in the Extra-Territorial Jurisdictional (ETJ) Area
FISCAL INFORMATION/CERTIFICATION.
The Land Agent for the City of Fort Worth has determined that a one dollar fee satisfies the
interest of the City of Fort Worth in this vacation request
