HomeMy WebLinkAboutOrdinance 11342~; •~ .~ / ~, ORDINANCE N0. /~ ~~• AN ORDINANCE AMENDING CHAPTER 27 OF THE CODE OF' THE CITY OF FORT WORTH, TEXAS (AS AMENDED); PROVIDING FOR THE PAYMENT OF ASSIGNMENT PAY TO POLICE OFFICERS ASSIGNED TO THE TRAFFIC INVESTIGATION UNIT WITHIN THE POLICE DEPARTMENT; PROVIDING THAT THIS ORDINANCE DOES NOT CREATE A NEW CIVIL SERVICE CLASSIFICATION OR VACANCY; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT OF THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE. BE IT HEREBY KNOWN: WHEREAS, the Chief of Police has advised the Council of the ongoing operations of the Police Department, and particularly in regard to the specialized operation of the Traffic Investigation Unit; and WHEREAS, the Council finds that those individuals in the Police Department assigned to perform the specialized duties and functions in investigating fatality motor vehicle accidents, DWI's, hit-and-run, accidents involving City vehicles or property, auto- pedestrian accidents and other reckless driving offenses are deserving of additional compensation by way of assignment pay; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Chapter 27 of the Code of the City of Fort Worth, Texas (1986), is hereby amended by adding a new Section 27-31 to read as follows: "sec. 27-31. Assignment Pay - Traffic Investigation Unit. "(a) The Police Chief may designate individuals in the Department .for assignment to the specialized duties of the Traffic Investigation Unit Police Officers so assigned will --;-. ; ~' perform the following additional and specialized functions within the unit: (1) Plan, direct, supervise and manage the daily operations of the Traffic Investigation Unit; and (2) Acquire and demonstrate a significant amount of specialized expertise in automobile accident reconstruction, investigation of fatality accidents, DWI's involving fatalities, hit and run accidents, auto-pedestrian accidents, reckless driving offenses, failure to stop and render aid accidents and driving with license suspended accidents. (3) Investigation of motor vehicle accidents involving City vehicles or City property. (4) Assist the District Attorney's office in the investigation, preparation and prosecution of motor vehicle offenses. (5) Perform other specialized duties as assigned by the Police Chief. "(b) Police Officers who perform the above specialized functions in the Traffic Investigation Unit shall receive in addition to their regular base salary an additional sum of one hundred twenty and no/S00 dollars ($120.00) per month. 'Base salary' shall be the amount as shown in the City's salary schedule for the current fiscal year." SECTION ,2. This ordinance does not create a new classified civil service rank or position within the Police Department. This ordinance does not create any new civil service vacancies at any classified rank or position within the Police Department. SECTION 3. The Mayor and Council Communication ("M&C") considered contemporaneously with this ordinance is hereby expressly incorporated herein by reference for purposes of determining the intended application of this ordinance. -2- ~{ ~ SECTION 4. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 5. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of .this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 6. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and Section 1 in the minutes of the City Council and by filing this ordinance in the ordinance records of the City. -3- in ~~ *; .. ~ SECTION 7. The amount of assignment pay must be established by ordinance and is in addition to the police officers' regular pay Such an ordinance may set criteria that provides for payment only to a police officer on a special assignment. The seven (7) Police Officers assigned to the Traffic Investigation Unit are responsible for the investigation of all fatality accidents, DWI's involving ,fatalities, hit and run accidents, auto-pedestrian accidents, reckless driving offenses, failure to stop and render aid offenses and driving with license suspended offenses. These Officers are required to investigate and prepare cases against individuals, then present them to the District Attorney's Office for prosecution These officers must acquire a significant amount of expertise through training to factually and accurately reconstruct accident scenes to ascertain the cause as well as determine if an individual must be prosecuted. Since these positions require the additional responsibility investigating and preparing cases for prosecution, the Chief of Police is requesting assignment pay be approved for the police officers in the Traffic Investigation Unit The additional cost for the remainder of the fiscal year for the seven (7) officers is $2,735.00. Savings from ' other areas in the Traffic Division budget will be used to offset the increased cost for this assignment pay.
