HomeMy WebLinkAboutOrdinance 11252 ORDINANCE NO ~~~ AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE ENVIRONMENTAL MANAGEMENT FUND IN THE AMOUNT OF $147,334.97 FOR THE PURPOSE OF ACCEPTING A REIMBURSEMENT FROM THE TEXAS WATER COMMISSION, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1992-93 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Environmental Management Fund in the amount of $147,334.97 for the purpose of accepting a reimbursement from the Texas Water Commission for remediation of leaking underground storage tanks at the Harley Street Service Center SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such. decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 11151 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Accept $147,334.97 from the Texas Water Commission (TWC) as reimbursement for eligible City costs associated with remediation of leaking underground storage tanks (UST's) at the Harley Street Service Center, and 2. Adopt the attached appropriations ordinance increasing estimated receipts and appropriations in the Environmental Management Fund by $147,334.97 form increased revenues. DISCUSSION: In May 1991, four (4) underground storage tanks were removed from the City's Harley Street Service Center. As a result of the subsurface release at the site, the TWC issued a Corrective Action Directive requiring the City to complete a site assessment and conduct quarterly groundwater monitoring. On May 20, 1992, the Department of Environmental Management submitted a request to the TWC's Petroleum Storage Tank Reimbursement Fund in the amount of $145,926.19. The reimbursement request covered the allowable costs for removal of the UST's, the initial site assessment, and the first three quarterly groundwater monitoring events. The City later filed an amendment to increase the request to $147,334.97. After review, the TWC approved the City's request in full. Staff recommends depositing the reimbursement into the Environmental Management Fund to pay for UST related costs during FY 1993.
