HomeMy WebLinkAboutOrdinance 11353~; ~~~ ".. ;,..+.~, ;r,. .. ., , i ORDINANCE N0. /~~s~ AN ORDINANCE AMENDING CHAPTER 2, "ADMINISTRATION", OF THE CODE OF THE CITY OF FORT WORTH (1986), AS AMENDED, BY AMENDING SECTION 2-116(3)(B); PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PROVISIONS OF PRIOR ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 2-116(3)(b) of Chapter 2 of the Code of the City of Fort Worth (1986), as amended, is hereby further amended to read as follows "b. City bidding procedure: The City Manager may promulgate an administrative regulation for contracts for purchases or sales in an amount less than that required by state statute to be competitively bid. Contracts for purchases or sales which are subject to this City bidding procedure and administrative regulation shall be let to be the lowest responsible bidder, qualify considered." SECTION 2. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. ~~~ ~~; - a SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. This ordinance shall be in full force and effect from and after its passage and publication as required by law, and it is so ordained. City of Fort ~ortl~, Texas ~ Mayor and Council Communication C7 DATE REFEREN E NUMBER L G NAME PAGE 07/06/93 G-10234 13PURAMT 1 of 1 SUBJECT ADOPTION OF ORDINANCE RAISING MAXIMUM DOLLAR AMOUNT FOR PURCHASE WITHOUT ADVERTISEMENT RECOMMENDATION: It is recommended that the City Council adopt the attached ordinance amending Section 2-116 (3)(b) of the Code of the City of Fort Worth, providing that the maximum amount for purchases without advertising for competitive bids be equal to that contained in state statutes. BACKGROUND: The Charter of the City of Fort Worth was amended in 1984 to provide all city contracts calling for or requiring the expenditure or payment of an amount required by the state law to be submitted to competitive bids in accordance with state law, such amount current by being set at $10,000.00 by state law. Effective September 1, 1993, that amount will be increased to $15,000.00 The City of Fort Worth's Purchasing Division is charged with the procurement of materials, equipment, supplies, and services required by all city departments. By city ordinance currently in effect all procurements in excess of $5,000.00 are competitively bid through advertising. The proposed ordinance will eliminate the stated dollar amount and permit the purchasing division to make procurement through competitive bidding, but without requiring advertising. All goods and services requested by departments that require a purchase order would not change or increase the control in departments. The change would a]low the Purchasing Division to increase its level of buying without the restricted limits of $5,000 00. Purchase Orders issued will be from $250 to the maximum state limit. Purchasing would increase it's productivity immed ately by responding to requests with less than a week turn around on items. Items that cost up to the state ]imits would be completed over the telephone. The current buying controls will remain in effect for all departments,, an only Purchasing wi]1 be allowed to act upon the increased competitive bidding authorization.
