ORDINANCE NO. ~~'~`' AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTINGUISHING A UTILITY EASEMENT LOCATED WITHIN THE RIVER BEND OFFICE PARK EAST ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the ten (10) foot wide by approximately five hundred twenty (520),foot long utility easement save and except the north forty (40) feet as it runs southward from the north property line and save and except the south forty (40) feet as it runs northward from the south property line, located on Lot 2R, Block 2, River f Bend Office Park East Addition, as recorded in Volume A, Page 1453, P.R.T.C.T., and as more specifically described in attached Exhibit "A", attached hereto and incorporated herein, be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated utility easement is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. a =~: SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Trimble Survey, Abstract No. 2. Said Lot 2R, Block 2, RIVERBEND EAST OFFICE PARK is recorded in Volume A, Page 1453 of the Deed Records, Tarrant County, Texas. The Vacation of the portion of 10' Utility Easement, being more particularly described as follows: Said easement vacation is described along the centerline of the 10' Utility Easement. Said centerline is along the common lot line of original Lots 3 and 4 Block 2, RIVERBEND EAST OFFICE PARK. BEGINNING at a point at the termination of a 10' Utility Easement to remain. Said point being S O1o29"19" W a distance of 66.97 feet from a 5/8" iron rod in the northerly property line. Said iron rod being N 66029"02" W a distance of 344.26 feet from the most northerly northeast corner of said Lot 2R. Said iron rod also being a corner of original Lot 3, Block 2, RIVERBEND EAST OFFICE PARK. It is recommended that the City Council approve the attached ordinance vacating a 10-foot wide by approximately 520-foot long utility easement located on Lot 2R, Brock 2, River Bend Office Park East Addition, save and except the north 40 feet beginning at the north property line and the south 40 feet beginning at the south property line, as recorded in Volume A, Page 1453, PRTCT DISCUSSION Mr Tom Kellerbrew, consultant for the developer of the subject property, has requested that the City vacate the above-described utility easement as further delineated on~ the attached map and field notes The easement does not contain any utility facilities A satisfactory replat has been submitted Reviewing City departments and private utility companies have raised no objections to this request This request is located in COUNCIL DISTRICT 4 FISCAL INFORMATION/CERTIFICATION.
