HomeMy WebLinkAboutOrdinance 11457;; _ ~~, ,> ORDINANCE NO ~_~~~ AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE ENVIRONMENTAL MANAGEMENT FUND IN THE AMOUNT OF $574,555.75 FOR THE PURPOSE OF FUNDING ENVIRONMENTAL PROJECTS, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1. That in addition to those amounts allocated to the various City departments for the Fiscal Year 1993- 94 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the General Fund in the amount of $574,555 75 for the purpose of funding environmental projects. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 11379 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. It is recommended that the City Council .adopt the attached supplemental appropriations ordinance increasing estimated receipts and appropriations in the Environmental Management Fund by S574,555 75 from prior year revenues and interest earnings DISCUSSION With the adoption of the FY 1992-93, the City Council created the Environmental Management Fund as a way to better identify the true cost of environmental projects undertaken by the Department of Environmental Management Revenue for this fund comes from the 50 cent Environmental Fee, state reimbursements for underground storage tank remediations, and transfers from the general fund The City began assessing the Environmental Fee in February 1992, prior to the creation of the Environmental Management Fund From February through September 1992, revenue from the Environmental Fee was deposited into the General Fund Because this revenue can only be used for specific purposes under the law, the City's FY 1991-92 external auditor required an audit adjustment which moved the Environmental Fee revenue collected from February 1992 through September 1992 from the General Fund to the Environmental Management Fund This audit adjustment was completed during the FY 1992-93 FY 1991-92 Environmental Fee 5500,824 11 FY 1992-93 Environmental Fee 29,644 94 FY 1992-93 Interest Earnings 5 44,086.70 TOTAL 5574,555 75 The actual amounts received from each of these sources is as follows ~=-~ Printed on recycled paper ~, Cry of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE NUIdBER LOCI NAIdE PAGE 11 /23/93 REVISED G10425 52PRIOR 2 of 2 susJECx SUPPLEMENTAL APPROPRIATION FOR THE ENVIRONMENTAL MANAGEMENT FUND FROM PRIOR YEAR REVENUES AND INTEREST EARNINGS The revenue will be used to help fund various environmental projects during FY 1993-94 including the installation of equipment upgrades on 26 underground storage tanks (UST's), the removal of 17 UST's and the installation of 5 aboveground storage tanks, engineering costs for 1994 UST projects, city-generated hazardous waste disposal, and emergency spill clean-up City Council approval will be required prior to the awarding of any contracts for these type of projects FISCAL INFORMATION/CERTIFICATION.
