AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTINGUISHING A UTILITY EASEMENT LOCATED WITHIN THE HULEN MALL ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the forty (40) foot wide by approximately three hundred eighty (380) foot long utility easement located in Lot 12, Block 1, Hulen Mall Addition, as recorded in Volume 388-107, Page 54, P.R.T.C.T., and as more specifically described in attached Exhibit "A", attached hereto and incorporated herein, be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated utility easement is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. ' DISCUSSION• Hulen Mall Joint Venture, owner of the subject property, has requested that the City vacate this utility easement (attached map and field notes). This easement is currently used as a sanitary sewer facility and will be retained for that purpose until such time as alternate sanitary sewer service is provided. This alternate sanitary sewer service will be established as part of the proposed expansion of Hulen Mall. Reviewing City Departments and private utility companies have raised no objections to this request. A satisfactory replat has been submitted. This request is located in COUNCIL DISTRICT 3. FISCAL INFORMATION/CERTIFICATION:. The Land Agent for the City of Fort Worth has determined that a one dollar fee satisfies the interest of the City of Fort Worth in this request.
