HomeMy WebLinkAboutOrdinance 11266A ~~ i~ !.` ~ ~~ i~ ORDINANCE NO. ~~~/ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING THREE STREET RIGHTS-OF-WAY AND THREE UTILITY EASEMENTS LOCATED WITHIN THE TUCKER'S ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the fifty (50) foot wide street right-of-way of Tucker Street as it runs from one hundred (100) feet east of Jennings Street easterly to St. Louis Street, as recorded in Volume 63, Page 124, P.R.T.C.T.; the sixty (60) foot wide street right-of-way of May Street as it runs from one hundred (100) feet south of West Peter Smith Street southerly to Annie Street, as recorded in Volume 63, Page 124, P.R.T.C.T.; the fifty (50) foot wide street right-of-way of Annie Street as it runs from May Street easterly to St. Louis Street, as recorded in Volume 63, Page 124, P.R.T.C.T.; the five (5) foot wide utility easement located along the east property line of Lot 1-R, Block 15, Tucker's Addition, as it runs from Annie Street southerly to the south property line of Lot 1-R, as recorded in Volume 388-103, Page 539, P.R.T.C.T.; the portion of the ten (10) foot wide utility easement located along the north property line of Lot 6-R, Block 9, Tucker's Addition, as it runs from May Street westerly to a point five (5) feet east of the west property line of Lot 6-R, as recorded in Volume 388-103, Page 535, P.R.T.C.T.; and the northern ten (10) feet of a forty (40 ) foot wide utility easement located near the south,-pxope~.t-fir C{TY ~~CR~ET~RY FT. WORTH, TEI~, !/ ~± ,~ r line of Lot 6-R, Block 9, Tucker's Addition, as it runs from May Street westerly to a point five (5) feet east of the west property line of Lot 6-R, as recorded in Volume 388-103, Page 535, P.R.T.C.T., and as all are more specifically described in attached Exhibit "A", attached hereto and incorporated herein, be and the same are vacated, abandoned and permanently closed and extin- guished. SECTION 2. That the fee to the land in the above described vacated street rights-of-way and utility easements is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. MAY STREET, WEST TUCKER STREET, AND WEST ANNIE STREET (V-92-1~) RECOMMENDATION: It is recommended that the City Council approve the attached ordinance vacating the following streets and easements: 1) Tucker Street (a 50 ft. wide right-of-way) as shown on the plat for Tucker's Addition to the City of Fort Worth, Tarrant County, Texas, from 100 ft. east of Jennings Street easterly to St. Louis Street, containing approximately 18,000 sq. ft. of land; 2) Ma_y Street (a 60 ft, wide right-of-way) as shown on the plat for Tucker's Addition to the City of Fort Worth, Tarrant County, Texas, from 100 ft. south of West Peter Smith Street, southerly to Annie Street, containing approximately 18,000 sq. ft. of 1 and; 3) Annie Street (a 50 ft. wide right of way) as shown on the plat for Tucker's Addition to the City of Fort Worth, Tarrant County, Texas from May Street easterly to St. Louis Street, containing approximately 13,000 square feet of land; 4) All of the 5 ft. wide utility easement along the east line of Lot 1-R, Block 15, Tucker's Addition to the City of Fort Worth,, Tarrant County, Texas, from Annie Street southerly to the south line of said Lot 1-R, containing approximately 500 square feet of land; 5) A portion of a 10 ft. wide utility easement along the north line of Lot 6-R, Block 9,, Tucker's Addition to the City of Fort Worth, Tarrant County, Texas, from May Street westerly to a point 5 feet east of the west line of Lot 6-R, containing approximately 950 square feet of land; 6) The northern 10 ft. of a 40 ft. wide utility easement near the south line of Lot 6-R, Block 9, Tucker's Addition to the City of Fort Worth, Tarrant County, Texas, from May Street, westerly to a point 5 feet east of the west line of said Lot 6-R, containing approximately 950 square feet of land. The above cited streets and rights-of-way were approved for vacation by the City Plan Commission on July 1, 1992. DISCUSSION: Tarrant County Mental Health and Mental Retardation Services, owner of all adjacent property except, but with the consent of John W. Freese, M.D., owner of Lot 3-A, Block 15, Tucker's Addition, has requested this vacation. The streets and easements were acquired by dedication and contain sewer, gas, telephone, television cable and electric utility facilities. Acceptable arrangements have been made for the removal of these facilities. Reviewing City departments and private utility companies have raised no objections to this request.
