AN ORDINANCE REPEALING CITY OF FORT WORTH ORDINANCE NO.
9899 AND AMENDING CHAPTER 2, ARTICLE IV, DIVISION 2,
"FINANCE", OF THE CODE OF THE CITY OF FORT WORTH, TEXAS
(1986), AS AMENDED, BY DELETING SUBPARAGRAPH C TO SECTION
2-116, PARAGRAPH (3), TO PROVIDE THAT THE CITY OF FORT
WORTH'S PURCHASING POLICY REQUIRING DISCLOSURE OF THE
EXTENT AND NATURE OF ANY BUSINESS RELATIONSHIPS
PROSPECTIVE BIDDERS MAY HAVE WITH THE GOVERNMENT OF THE
REPUBLIC OF SOUTH AFRICA OR WITH ENTITIES DOING BUSINESS
IN OR WITH THE REPUBLIC OF SOUTH AFRICA BE RESCINDED;
PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR
ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION I.
That City of Fort Worth Ordinance No. 9899 is hereby repealed
and Chapter 2, Article IV, Division 2, "Finance!', of the Code of
the City of Fort Worth, Texas (1986), as amended, be amended by
deleting Paragraph (3), Section 2-116, Subparagraph c.
SECTION II.
This ordinance shall be cumulative of all ordinances of the
City of Fort Worth on this subject except where the provisions of
this ordinance are in direct conflict with the provisions of any
such ordinances, in which event conflicting provisions of such
ordinances are hereby repealed.
SECTION III.
It is hereby declared to be the intention of the City Council
that the sentences, clauses and phrases of this ordinance are
severable, and, if any phrase, clause or sentence of this ordinance
be declared invalid by the judgment or decree of any court of
competent jurisdiction, such invalidity shall not affect any of the

remaining phrases, clauses or sentences of this ordinance since the
same would have been enacted by the City Council without the
incorporation in this ordinance of any such invalid phrase, clause
or sentence.
SECTION IV.
The City Secretary of the City of Fort Worth is hereby
directed to engross and enroll this ordinance by copying the
caption and effective date in the minutes of the City Council and
by filing the ordinance in the ordinance records of the City.
SECTION V.
This ordinance shall be in full force and effect from and
after the date of its passage, and it is so ordained.

RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance repealing Ordinance No
9899 and rescinding the City's purchasing policy requirement that all vendors disclose their
business ties to South Africa
DISCUSSION

On June 23, 1987, the City Council
adopted Ordinance No 9899 which amended Chapter 2,
Article IV, Division 2 of the City Code The ordinance pertains to purchasing procedures and
requires that "any entity proposing to contract with the City disclose the extent of their
ownership or other business with the governments of the Republic of South Africa and/or
Namibia, or doing business in the Republic of South Africa or Namibia "
Following the independence of Namibia, the City Council amended Ordinance No 9899 on June
2, 1992 to revoke any reference to the Nation of Namibia
Given the movement toward democracy now underway in South Africa, Nelson Mandela,
President Clinton, the National Black Caucus of Local Elected Officials, and many others, are
urging cities and states to remove any existing sanctions against South Africa Mr Mandela
recently stated in an open letter to the U S based organization, the Africa Fund
"[I] hope that the cities and states that were the firm backbone of the anti-apartheid
movement in the United States will commit themselves to actively supporting reinvestment
in the South African economy in a socially responsible manner which will help address the
devastating legacy of apartheid Sanctions played a critical role in bringing us close to
freedom day and I wall be forever grateful to the American people "
