HomeMy WebLinkAboutOrdinance 11279~~~ _ x t' / J~< ORDINANCE N0. 1a2 ~~';1~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTINGUISHING A UTILITY EASEMENT LOCATED WITHIN THE BOB MOORE SUBDIVISION OF THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the five ( 5 ) foot wide by one hundred fifty-six point forty-four (156.44) foot long utility easement located along the east property line, beginning at the south property line and extending north one hundred fifty-six point forty-four (156.44) feet, of Lot 2, Block 1, Bob Moore Subdivision, as recorded in Volume 388-71, Page 60, P.R.T.C.T., and as more specifically described in attached Exhibit "A", attached hereto and incorporated herein, be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated utility easement is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. DISCUSSION: Autozone Inc., owner of the subject property, has requested that the .above described utility easement be vacated in order to expand the building an auto parts store. The property was recently re-zoned for no utility facilities within the portion of this utility area for construction of this purpose. There are easement to be vacated. Reviewing city departments and private utility companies have raised no objection to this request. This request is located in COUNCIL DISTRICT Number 4. FISCAL INFORMATION/CERTIFICATION: The Land Agent for the City of Fort Worth has determined that interest of the City of Fort Worth in this request. a $1.00 fee satisfies the MG:b O~~IClAl.
