HomeMy WebLinkAboutOrdinance 11487..R ' ~I _ ORDINANCE NO l~ AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND IN THE AMOUNT OF $112,895 00 FOR THE PURPOSE OF PURCHASING TWO MOTOR HOMES FROM MCCLAIN'S R.V FOR THE POLICE DEPARTMENT, PROVIDING FORA SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1. That in addition to those amounts allocated to the various City departments for the Fiscal Year 1993- 94 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund in the amount of $112,895.00 for the purpose of purchasing two motor homes from McClain's R. V for the Police Department. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 11379 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. HOMES FROM MC CLAIN'S R V -FOR THE POLICE I DEPARTMENT RECOMMENDATION. 1 Accept 587,895 00 in donations from various foundations and individuals, and 2 Adopt the attached appropriations ordinance increasing estimated receipts and appropriations in the Special Trust Fund by 5112,895 00 from increased revenues, and 3 Authorize the purchase of two motor homes for the Police Department from McClain's R V on the low bid meeting specifications for an amount not to exceed 5142,720 00, f o b destination, freight no charge and payment terms due upon receipt and acceptance of the motor homes BID TABULATION VENDOR TOTAL BID 1 Vogt Family Fun Center 5126,200 00 Fort Worth, TX 2 McClain's R V 5142,720 00 Lake Dallas, TX DISCUSSION Invitations to bid were mailed to four prospective bidders Two vendors did not respond This bid was advertised in the Fort Worth Star-Telegram on December 10 and 17, 1993 The first low bid submitted by Voght Family Fun Center failed to meet_bid specifications as follows 1 Specifications required the vehicle to be provided with a three year/36,000 mile, no deductible factory sponsored bumper-to-bumper 100% parts and labor warranty The Vendor failed to meet this specification 2 Part I Section 10 of the specifications required the vendor to provide service and parts operations manuals Vendor can not supply parts or service manuals 3 Vendor also failed the requirement to supply a detailed summary of the manufacturer's recommended service intervals +•~~ Printed on recycled paper City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE NUMBER LO(3 NAME PAGE G10504 930639R 2 of 2 susJECT PURCHASE TWO MOTOR HOMES FROM MC CLAIN'S R V FOR THE POLICE DEPARTMENT Additionally, several other restrictions were added by the vendor 1 Article 7, number 2, the seller disclaims any and all warranties, stating that the vehicle is being sold as is 2 Article 10, number 3b, states that parts and service manuals are not available from Tiffin Motor Homes on the coach portion 3 Article 12, number 5 states that recommended spare parts are not available from Tiffin Motor Homes 4 Article 17, number 9 requires a 15% down payment with the order and the balance due upon receipt and acceptance of the motor homes The major portion of the funding required for the purchase of the two Mobile Command Units is being provided through donations from individuals and foundations On April 20, 1993 (M&C G-10134), the City Council appropriated 533,573 29 in donations that had been received at that time Since that date, an additional 537,895 in contributions have been received and the Carter and Meadows Foundations have pledged to donate 525,000 each upon adoption of this M&C This M&C authorizes the acceptance of all donations since April 20, 1993, including the 550,000 from the Meadows and Carter Foundations (537,895 in received contributions + 550,000 in pledges = 587,895), appropriates the new contributions as well as 525,000 from .awarded assets, and authorizes the actual purchase of the Mobile Command Units The bid submitted by Mc Clain's R V meets or exceeds all specifications FISCAL INFORMATION/CERTIFICATION.
