HomeMy WebLinkAboutOrdinance 11291''] ORDINANCE NO / /~~/ AN ORDINANCE APPROPRIATING $32,000 00 TO THE GENERAL FUND AND DECREASING THE UNRESTRICTED, UNDESIGNATED FUND BALANCE BY THE SAME AMOUNT FOR THE PURPOSE OF FUNDING AN AGREEMENT BETWEEN THE CITY OF FORT WORTH AND THE CARSWELL REDEVELOPMENT AUTHORITY FOR THE ADVANCEMENT OF FUNDS FOR CARETAKER AGREEMENT NEGOTIATIONS, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING AI:L PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED' BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1992-93 and in the Budget of the City Manager, there shall also be increased appropriations in the General Fund in the amount of $32,000 00; thereby decreasing the unrestricted, undesignated fund balance by the same amount, for the purpose of funding an agreement between the Ci of Fort Worth and the Carswell Redevelopment Authority for the advancement o~ funds for Caretaker Agreement negotiations. SECTION 2 Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 11151 and all other ordinances and appropriations amending the same except iri those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Adopt the attached supplemental appropriations ordinance increasing appropriations by $32,000.00 in the General Fund, Non-Departmental, and decreasing the unreserved, undesignated fund balance of the General Fund by the same amount, and 2. Authorize the City Manager to execute the attached agreement between the City of Fort Worth and the Carswell Redevelopment Authhority advancing the Carswell Redevelopment Authority $32,000.00 for professional services related to the preparation and negotiation of the Caretaker Agreement between the Carswell Redevelopment Authority and the Department of DE~fense Air Force Base Disposal Agency. DISCUSSION: The Department of Defense Air Force Base Disposal Agency (AFBDA) is responsible for the care of all facilities at Carswell Air Force Base upon closure of the base as a military facility effective September 30, 1993. The AI=BDA is authorized, in turn, to contract with an outside agency for the care of all facilities at the military base. The Carswell Redevelopment Authority desires to contract with the AFBDA to provide this caretaker service upon the abandonment of the base effective September 30, 1993. The Carswell Redevelopment Authority anticipates expending approximately $32,000.00 in legal and other professional services related to the negiotiation and preparation of the Caretaker Agreement with the AFBDA. These expenses .are eligible for reimbursement through the Caretaker Agreement with the AFBDA. The Carswell Redevelopment Authority has asked the City of Fort Worth to advance the funds for the negotiation of the Caretaker Agreement, with the intent of reimbursing tlhe City of Fort Worth once the Carswell Redevelopment Authority is reimbursed through t:he Caretaker Agreement with the AFBDA. The Caretaker Agreement between the Carswell Redevelopment Authority and the AFBDA is expected to be approved approximately July 1., 1993, in order to provide a three month transition period before the military base is closed. The City of Fort Worth would be reimbursed shortly after the execution of the Caretaker Agreement between the Carswell Redevelopment Authority and the AFBDA. This agreement between the City of Fort Worth and the Carswell Redevelopment Authority requires the Carswell Redevelopment Authority to provide monthly reports to the City of Fort Worth detailing the expenditure of the $32,000.00. aI:I:ICIAI. The Director of Fiscal Services further certifies that upon reimbursement by the Carswell Redevelopment Authority, the $32,000.00 will be returned to the General Fund's unreserved, undesignated fund balance.
